EAARTH DM is a secure messaging and communications service operated by Eaarth Ltd, a company incorporated in England and Wales (Company No. 14940705), registered address: Little Mead, Leighton Road, Great Billington, Leighton Buzzard, LU7 9BJ, England. All communications are encrypted in transit; end-to-end encryption is being rolled out, see Section 3.
EAARTH DM provides text messaging, voice calls, video calls, file sharing, and group communications. It is already live, embedded inside EAARTH OS, for production teams. The standalone public version is coming soon.
2.1 You must be at least 16 years old to use EAARTH DM. If you are aged 16 or 17, you should ensure a parent or guardian has reviewed these Terms. This 16-plus minimum is enforced separately from EAARTH OS's 18-plus minimum, checked against the verified date of birth from your government ID rather than the age you state at signup, even though both products share one EAARTH account system; see our Privacy Policy, Section 10.
2.2 You must create a genuine account in your own name. EAARTH DM verifies every account holder's identity at registration, either through an automated Face ID match or a manual, document-only check reviewed by a real person; you cannot create accounts impersonating another person. See our Privacy Policy, Section 4, for how these two verification paths work and why each is lawful, and Section 8, for your rights around automated decisions and how to raise it if a Face ID check fails.
2.3 One account per person. Operating multiple personal accounts is prohibited.
3.1 EAARTH DM is being upgraded to end-to-end encryption, so that only you and the people you're communicating with can read your conversations, not Eaarth Ltd. Until this rollout is complete for a given conversation type, messages are protected in transit and at rest using industry-standard encryption, and access is restricted to what's necessary to operate the service.
3.2 Once end-to-end encryption is active for your conversation, Eaarth Ltd has no technical ability to read, listen to, or view its content, and holds no decryption keys for it. We will publish exactly which conversation types have end-to-end encryption live as each stage completes.
3.3 If you lose access to your devices, your message history cannot be recovered by Eaarth Ltd. You are responsible for backing up your own data.
4.1 You retain full ownership of all content you create and share on EAARTH DM, including messages, media files, voice notes, and documents.
4.2 By using EAARTH DM, you grant Eaarth Ltd a limited, non-exclusive licence to store and transmit your content only as needed to deliver it to your intended recipients. We do not use this licence to read, sell, or analyse the content of your communications for any other purpose.
4.3 You are solely responsible for the content you share. You must not share content that is illegal, harmful, harassing, defamatory, or that infringes third-party intellectual property rights.

Violation of these prohibitions may result in immediate account suspension and referral to law enforcement where applicable.
6.1 Eaarth Ltd processes metadata (e.g., who you communicate with, when, and how often) for the purposes of operating the service, security monitoring, and legal compliance. This metadata is processed in accordance with UK GDPR.
6.2 We do not sell, share, or use your communication metadata for advertising purposes.
6.3 We comply with all UK legal obligations. Where UK law requires us to disclose information, for example a valid court order or law enforcement request, we will disclose what we actually hold. Today, that can include metadata (who you messaged, when, and group membership) and, until end-to-end encryption is live for a given conversation (see Section 3), the content of that conversation. Once end-to-end encryption is active for a conversation, its content is not accessible to us and cannot be produced, even under compulsion, a deliberate architecture choice, not a refusal to cooperate with the law. We will inform you of such requests where legally permitted to do so.
6.4 Full details of how your data is processed are set out in our Privacy Policy at eaarth.app/privacy.
6.5 Message content is retained for as long as your account and the relevant conversation exist. Message metadata, who you messaged, when, delivery timestamps, and read-receipt records, is kept in full detail for 24 months, then automatically reduced to month-level detail with individual read receipts deleted, unless a specific conversation or user is under an active legal hold, in which case full detail is preserved until the hold is lifted. See our Privacy Policy, Section 7, for exactly what that means in practice, including what happens when you delete a message or close your account.
7.1 Group creators and administrators are responsible for setting and enforcing group rules, and for removing members who violate these Terms.
7.2 Group administrators should not add members to groups without their prior consent.
7.3 Group size limits and other technical constraints are set by Eaarth Ltd and may change with notice.
EAARTH DM is provided on an "as available" basis. Eaarth Ltd does not guarantee uninterrupted service. We will use reasonable endeavours to maintain uptime but are not liable for outages caused by third-party infrastructure, network issues, or circumstances beyond our control.
You can report abusive content, accounts, or messages directly within the app. Eaarth Ltd reviews all reports and will take action including suspension, deletion, and referral to authorities where appropriate.
To report urgent safety concerns, use the in-app report feature, or contact us through in-app chat and mark your message urgent.
10.1 You may delete your account at any time within the app settings. Deleting your account deactivates it immediately, you are signed out and cannot use EAARTH DM or EAARTH OS until and unless you reactivate. Your identity-verification and biometric data (legal name, date of birth, document type/number, verification status, and the biometric face reference held by our verification provider) is then kept for 30 days: if you log back in within that window, your account and this data are fully restored and you do not need to redo identity verification. If you do not log back in within 30 days, this data is permanently deleted, including instructing our verification provider to delete the underlying biometric face template, and you would need to complete identity verification again from scratch if you ever return. See our Privacy Policy, Section 7, for the full detail. Account deletion does not retroactively delete the content of messages you have already sent to other people, those remain in the conversation for the other participants, in the same way deleting your account with any messaging service does not unsend messages you have already delivered. You can delete an individual message yourself at any time from within a conversation, which does remove its content from our systems. Where end-to-end encryption is active for a conversation, message content delivered to other participants exists only on their own devices, not on our servers, regardless of your account's status.
10.2 Eaarth Ltd may suspend or terminate accounts that violate these Terms, without notice where the violation is serious (e.g., CSAM, terrorism).
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
