EAARTH PAY is a payment initiation service operated by Eaarth Ltd, a company incorporated in England and Wales (Company No. 14940705), registered address: Little Mead, Leighton Road, Great Billington, Leighton Buzzard, LU7 9BJ, England.
We are registered with the Information Commissioner's Office (ICO Ref: ZC173483). Payment services are provided using the regulatory permissions of our banking and payments partners, including TBC, which is authorised and regulated by the Financial Conduct Authority for payment and e-money services. Eaarth Ltd does not hold, and has not applied for, its own FCA authorisation. We are not a bank and do not hold or custody your funds, these are held by our regulated partners.
2.1 Pay-by-bank: When you make a payment via EAARTH PAY, we initiate a bank transfer directly from your current account to the merchant's bank account using open banking. You authenticate the payment through your own bank's app or website, no card details are ever shared with us or with the merchant.
2.2 QR payments: You can scan a merchant's EAARTH QR code to initiate a payment. The QR code opens a secure payment request which you confirm in your bank's app.
2.3 No card storage: EAARTH PAY does not store, process, or transmit card numbers. All payments are bank-to-bank. Your bank account number and sort code are used solely to initiate the payment you have authorised and are not retained by Eaarth Ltd.
3.1 You must be aged 16 or over to use EAARTH PAY as a payer.
3.2 You must hold a UK bank account that supports open banking (the majority of UK high-street and digital banks support this).
3.3 You must have the legal authority to make payments from the bank account you use. Shared or joint account holders must each have authority to initiate payments independently.
4.1 You are responsible for ensuring that any payment you initiate is accurate, including the amount, currency, and intended recipient. Eaarth Ltd cannot reverse a completed bank transfer.

4.3 Under the Computer Misuse Act 1990, any unauthorised access to or manipulation of payment systems is a criminal offence. Eaarth Ltd will cooperate fully with law enforcement in the event of suspected fraud or misuse.
5.1 If you believe a payment was made without your authorisation, you should contact your bank immediately. As a PISP, Eaarth Ltd does not hold funds and cannot reverse transactions, your bank is the appropriate point of contact for disputed or fraudulent payments.
5.2 You should also report any suspected fraud to Eaarth Ltd at support@eaarth.app so we can log the incident, cooperate with your bank, and take appropriate protective action on your account.
6.1 We process your personal data in accordance with our Privacy Policy (eaarth.app/privacy) and UK GDPR.
6.2 Data used during payment initiation (your bank identifier, payment reference, amount) is processed in real time and not retained beyond what is required for the transaction record and legal compliance.
6.3 We do not sell your data to third parties, use it for advertising, or share it with merchants beyond what is necessary to complete your payment (e.g., your name as shown by your bank).
EAARTH PAY is free for payers. There are no charges to you for making payments, regardless of transaction size. Fees are paid by the merchant receiving the funds.
8.1 To create an EAARTH PAY account, you will be asked to complete a live selfie verification matched against a government-issued photo ID. This is processed using AWS Rekognition.
8.2 Biometric data is used solely to verify your identity at registration and is not used for any other purpose. It is processed in accordance with Article 9 of UK GDPR as a special category of data, with your explicit consent.
8.3 You have the right to request deletion of your biometric data at any time by contacting support@eaarth.app.
You may close your EAARTH PAY account at any time by contacting support@eaarth.app. Eaarth Ltd may suspend or close your account immediately if there is suspicion of fraud, misuse, or breach of these Terms.
10.1 If something goes wrong, tell us first. Email support@eaarth.app with "Complaint" in the subject line and as much detail as you can give us. We will acknowledge your complaint within 5 business days and aim to give a full response within 15 business days; where a payment issue needs input from our banking partner or your own bank, it can take longer, and we will tell you if that happens.
10.2 Eaarth Ltd is not itself authorised or regulated by the Financial Conduct Authority (see Section 1). EAARTH PAY's payment rails run on the regulatory permissions of TBC, which is FCA-authorised for payment and e-money services. Because of this, whether a complaint about the payment side of the service is eligible to go to the Financial Ombudsman Service (FOS) against Eaarth Ltd depends on the specific regulatory arrangement in place between Eaarth Ltd and TBC at the time, this is not something we can promise either way in a general Terms document. If our own response does not resolve your complaint, we recommend also raising the underlying payment issue directly with TBC, as the FCA-authorised institution actually providing the rails, who can confirm whether your complaint falls within the FOS's jurisdiction.
10.3 Where the FOS does have jurisdiction over a complaint, it is a free, independent service for eligible consumers, and a complaint must usually be referred within 6 months of a final response. These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
